This Data Protection Addendum (the “Addendum”) is entered into by and between Nirvana Project / Miracles Squad LLC, a U.S. entity with a principal address at 355 N Central Ave, Apt 1220, Phoenix, AZ 85004, USA (“Nirvana Project”, “Processor”, or “We/Us”), and the customer agreeing to this Addendum (“Customer” or “Controller”).
This Addendum is effective as of the Addendum Effective Date (defined below) and supersedes any prior data protection addendum between the parties covering the Services.
If you are accepting this Addendum on behalf of a Customer or Affiliate, you represent and warrant that:
you have read and understood this Addendum;
you have authority to bind the applicable entity; and
you agree, on behalf of that entity, to this Addendum.
If you do not have such authority, do not Sign/Accept/Opt-In.
This Addendum sets out the terms governing Nirvana Project’s processing of Customer Personal Data under the master agreement, order form(s), privacy policy, or terms of service between Nirvana Project and Customer (the “Agreement”).
Addendum Effective Date: the date Customer clicks to accept, e-signs, or otherwise opts into this Addendum.
Adequate Country: a third country, territory, or specified sector recognized under GDPR Art. 45 as providing an adequate level of data protection.
Data Subject: an identified or identifiable natural person whose Personal Data is processed.
Personal Data: any information in Customer Data relating to an identified or identifiable natural person as defined by EU Data Protection Law.
Processing / Processed: any operation or set of operations performed on Personal Data (GDPR Art. 4(2)).
Data Controller (“Controller”): the party that determines the purposes and means of processing Personal Data.
Data Processor (“Processor”): the party that processes Personal Data on behalf of the Controller.
Data Transfer Mechanism: a lawful transfer solution recognized by EU/UK data protection law (e.g., EU Standard Contractual Clauses (SCCs) 2021/914, UK IDTA or UK Addendum to the EU SCCs).
